DISCLAIMER OF LIABILITY AND ASSUMPTION OF RISKS
  1. The yoga classes offered during the FLOW festival do not constitute medical advice. It is the participant’s duty to respect their physical and psychological limits for all postures or exercises. FLOW and La Cuisine Communications Inc. cannot be held responsible for any physical or psychological harm experienced as a result of taking the classes and activities offered during the Festival, including the Sauna and Ice Bath and Sup Yoga.
  2. By purchasing your ticket to participate in Yoga classes, activities and workshops on our website flowfestival.ca, you agree to the following points:
  • I understand that certain risks are common to activities that take place at a Yoga festival. I am aware of and take responsibility for any injury or damage that I may suffer or cause to other participants.
  • I understand that Flow Festival and La Cuisine Communications Inc. are not responsible for any lost or stolen property on the Festival site. I affirm that I am physically capable of participating in the activities of the Flow Festival and I assume full responsibility for any injuries incurred.
  • If I register my child(ren) for the Youth Animation Workshops and if I have my child looked after by the educator and I am absent, I understand that Flow Festival and La Cuisine Communications Inc. are not held responsible for injuries, allergy problems or damage that my child may suffer or cause to other children on the Festival site.

Following the statements above, I declare the following:

  1. By purchasing my ticket on this website or in person on the day of the event, I acknowledge that I have read the aforementioned disclaimer and understand its content; that I am at least eighteen (18) years old and fully competent to give my consent;
  2. That I have been sufficiently informed of the risks involved and that I have given my voluntary consent by signing it as my own act and free act;
  3. That I give my voluntary consent by signing this disclaimer as my own deed and deed with the full intention of being bound by it, and free of any inducement or representation.

SUMMARY OF REFUND POLICIES

Your ticket is non-refundable, but it is possible to transfer it to another person, in case you cannot join us. Contact us to change the participant’s name at tickets@flowfestival.ca. Enter their name, order number and email.

  • Promotional packages are neither exchangeable nor refundable.
  • You cannot be reimbursed if you do not show up at the Festival.
PURCHASE OF TICKETS AND GENERAL CONDITIONS OF THE FESTIVAL

TICKET POLICY

All sales are final—If the festival is postponed or rescheduled, tickets are neither refundable nor replaceable, but they are transferable and will automatically roll over to the new festival dates.

RISK STATEMENT – FLOW FESTIVAL YOGA & SOUND

There are risks involved in any event. By attending the event (FLOW Festival Yoga & Sound), you assume all risks associated with the event and release event management, ticketing, charity partners, event organizers and their affiliates respective parties for all claims relating to or arising from the event or your attendance at the event. The ticket you hold is subject to all applicable policies of the event management. This ticket is a revocable license to enter the event on the date and time indicated on the front. This means that management reserves the right, without paying a refund, to refuse entry or eject you if you do not comply with all management policies applicable to the event. The date and time of the event are subject to change. Resale and/or transfer of the ticket may be prohibited by management policies, and if so, such resale and/or transfer is void to the maximum extent permitted by applicable laws. Any unauthorized resale and/or transfer may result in refusal of registration without refund. Tickets not obtained directly from Management may be lost, stolen, counterfeit or invalid, in which case they will not be honored.

AGREEMENT

Any purchase or possession of tickets (including wristbands, “Ticket(s)”) for FLOW Festival Yoga & Son (the “Festival”) constitutes irrevocable acceptance of, and agreement to be bound by, all of the terms and conditions contained herein, by you as the purchaser, bailee or holder of the Note(s) (hereinafter referred to as “you” or “your”). You further acknowledge and agree that FLOW Festival Yoga & Son, the Festival Organizer, EVENT ORGANIZER and/or EVENT ORGANIZER (La Cuisine Communications Inc.) and its authorized subcontractors may, from time to time, modify, add, delete, supplement, amend, update or otherwise revise any or all of the terms and conditions contained herein from time to time, without prior notice, direct or individual (collectively “Revise or Revision (s)”) and that Revisions must, at the sole and absolute option of the Festival Organizer, relate back to the date of purchase. The Festival Organizer shall have the right to revise any or all of the terms or conditions specified herein from time to time by posting such revisions on the Festival website located at https://flowfestival.ca/ (the “Site”). If you do not agree to be bound by these terms and conditions, do not purchase Tickets.

REVOCABLE LICENSE

Your ticket will at all times be deemed a revocable license issued by EVENT ORGANIZER, as licensor hereunder or its respective agent(s) (“EVENT ORGANIZER” and sometimes also referred to as “we”, “our”). ” or “we”) for the sole purpose of accessing the venue where the Festival is scheduled (the “Venue”) and attending the Festival (the “License”). The license may, in the sole and absolute discretion of the EVENT ORGANIZER, be revoked at any time by the EVENT ORGANIZER with or without further notice, including denial of access to the Site following or due to any violation, or suspected violation, of any or all of these terms and conditions or for any violation or alleged violation of any applicable law, policy, rule or regulation, as determined by the EVENT ORGANIZER or its subcontractors.

LOST, STOLEN OR DESTROYED TICKETS

The EVENT ORGANIZER, its subcontractors and its agents assume no legal, financial or other liability for lost, stolen, destroyed or misplaced Tickets. Following delivery of Your Tickets, You assume 100% risk of loss relating to the Tickets, including any risk of loss associated with lost, stolen, misplaced or destroyed Tickets.

TICKETS NOT EXCHANGEABLE FOR CASH

Your ticket cannot be exchanged for cash.

CHANGES IN PROGRAMMING, DATE OR LOCATION

The EVENT ORGANIZER, at any time before the Festival, has the right to change the Suppliers, Venue, Artist Programming, Festival Times, Festival Dates or any other element of the Festival, at any time, with or without notice to You and without any compensation to You. If you do not agree with ANY of the terms and conditions set forth in this paragraph OR AGREEMENT, do not purchase tickets.

CANCELLATION OF THE FESTIVAL BY THE EVENT ORGANIZER

In the event of cancellation of the Festival by the EVENT ORGANIZER, the EVENT ORGANIZER will have the option: (a) elect to issue a refund to the registered Ticket purchaser in an amount equivalent to the face value of the Tickets only (or a prorated part thereof, in the event of a partial cancellation) or (b) postpone the Festival to a future date within the 12 month period immediately following the cancellation of the Festival by the EVENT ORGANIZER. If the canceled Festival is postponed to a later date, You will not be entitled to a refund. Purchasing Tickets in accordance with these terms and conditions exposes You to a high degree of risk in relation to possible cancellations of the Festival. If you do not agree with, or agree to assume the allocation of risks TO YOU AS SET FORTH HEREIN, ANY of the terms set forth in this paragraph OR AGREEMENT BELOW, do not buy Tickets.

REFUNDS FOR CANCELLATION BY THE EVENT ORGANIZER

In electing to issue refunds under subparagraph (a) of this Paragraph 7 below, the following will apply: EVENT ORGANIZER will issue refunds less any credit card processing fees at 3.29%. Once the doors of the Venue are opened, the Festival on that particular date will be deemed to have been delivered in its entirety and will not be subject to any refund. Delayed gate openings will not be subject to refunds. Under no circumstances will you be entitled to a refund of any shipping, handling or other processing charges. Purchasing Tickets in accordance with these terms and conditions exposes you to a high degree of risk in relation to possible cancellations of the Festival. If you do not agree with any of these terms and conditions set forth in this paragraph or otherwise set forth in this Agreement, or if you do not agree with, or agree to assume the allocation of risk transferred to you hereunder, do not purchase tickets.

FORCE MAJEURE EVENTS

In the event of cancellation of the Festival for reasons other than those specified in paragraph 7 above (“Cancellation of the Festival by the EVENT ORGANIZER”), including but not limited to events unrelated to the will of the EVENT ORGANIZER, acts of God, pandemics (e.g. COVID-19) riots, wars, insurrection of military power, civil rebellion, production delays, strikes, hurricanes, tropical storms, earthquakes earth, floods, natural disasters or bad weather (whatever the severity), the ORGANIZER OF THE EVENT must, in its sole and absolute discretion ( a) has the right, but not the obligation, to issue you a refund (including partial refunds under the conditions specified or contemplated in paragraph 8 above) or shall, in its discretion, (b) choose to postpone the Festival or (c) cancel the Festival without further legal or financial obligation or liability to you, including the obligation to refund you or reschedule the Festival. Purchasing Tickets in accordance with these terms and conditions exposes You to a high degree of risk in relation to possible cancellations of the Festival. If you do not agree with any of these terms and conditions set forth in this paragraph or otherwise set forth in the Agreement, or if you do not agree with or agree to assume the allocation of risk transferred to you hereunder, do not purchase tickets. If the EVENT ORGANIZER chooses to issue a refund, the registered Ticket purchaser will be refunded an amount equivalent to the face value of the Ticket(s) only, less any credit card processing fees at 3.29%. If the EVENT ORGANIZER chooses to postpone the Festival to a later date, you may not be entitled to a refund. Under no circumstances will you be entitled to a refund of any shipping, handling or other processing charges.

POSTPONEMENT OF THE FESTIVAL

Unless otherwise specified herein, at any time before the Festival, the EVENT ORGANIZER reserves all rights to cancel or postpone the Festival or to modify the Venue, the artist lineup, the list of suppliers, the time, date of the Festival or other matters relating to the Festival, without any obligation on the part of the EVENT ORGANIZER to give you any additional or prior notice or compensation.

NOTICE OF CANCELLATION OR POSTPONEMENT OF THE FESTIVAL

If the Festival is canceled or postponed, in whole or in part, or if the Venue is closed, the EVENT ORGANIZER will publish a notification on the Site relating to this cancellation or postponement.

ALL TICKET SALES ARE FINAL, THERE WILL BE NO REFUNDS AND/OR EXCHANGES OF TICKETS.

This festival is a “rain or shine” festival. This festival is “Standing Only”. Unless otherwise specified herein, there will be NO refunds or exchanges with respect to purchases of Tickets. If you do not agree to these terms and conditions set forth in this paragraph or otherwise set forth in this agreement, do not purchase tickets.

ACCEPTANCE OF RISKS

You assume all risks, whether expressly set forth herein, and all other risks and dangers incidental to or in any way connected with your presence during the Festival, including all risks which arise before, during or after the Festival or any risks which are not foreseeable, such as any risks arising from or relating to the acts or omissions of others (including Artists, Festival participants, owners or operators of the Venue and its staff , its employees and agents; or the EVENT ORGANIZER, the Festival organizer, its affiliates, subsidiaries, officers, directors, employees, members, partners, agents or delegates).

LOST OR STOLEN PROPERTY

The Festival Organizers and their respective Indemnitees (defined in paragraph 18 below) will not be held responsible, financially or otherwise, for any personal property left, lost, stolen, destroyed, confiscated, damaged or misplaced anywhere at the Venue. or during the Festival, whatever the fault. You assume all risk of loss associated with loss or damage to your personal property.

FESTIVAL RISKS

You assume all risk of injury related to your participation in the Festival, including but not limited to projectiles, hearing loss, seizures and other incidental health problems, relating to or resulting from the music and sounds strong.

COMPENSATION

In exchange for additional consideration, the receipt and sufficiency of which is herein acknowledged by you and the EVENT ORGANIZER, you agree to defend, covenant not to sue, indemnify, save and forever hold harmless the EVENT ORGANIZER, venue owners and all of their respective subsidiaries, affiliates, officers, directors, directors, members, employees, authorized agents, predecessors, assigns, successors, licensees and designees (collectively the “Indemnitees”) from all injuries (whether personal injury, property damage or otherwise), demands, suits and/or claims in any way related to the Festival, to the maximum extent permitted by applicable law.

RIGHT TO REGISTER AND EXPLOIT YOUR IMAGE

The EVENT ORGANIZER, the EVENT ORGANIZER and its subcontractors, shall have the right to publish, print, display or use publicly for any commercial purpose or advertisers’ name, image, likeness, photograph, voice or other likeness of you without your additional written or oral consent. The EVENT ORGANIZER will also have the right, but not the obligation, to use your name, image, portrait, voice, photograph or other likeness in connection with the resale or other distribution of literary, musical or artistic or other merchandise items. or goods without your further consent in connection with any sale or distribution thereof. You further acknowledge and agree that the EVENT ORGANIZER will be the sole and exclusive owner of any work containing your image. the EVENT ORGANIZER will also have the right to record, use, publish, print, display, exploit and publicly use your name, image, likeness and voice on a media, whether non-existing or hereinafter created, including through any broadcast, rebroadcast, live stream, recording or other reproduction of your image on or about the Festival, and whether in or out of context.

NO ILLICIT DRUGS; NO WEAPONS

THE EVENT ORGANIZER and the Venue maintain a zero tolerance policy regarding the use of illegal or illicit drugs on the Venue or otherwise during the Festival. You knowingly, intelligently and voluntarily consent to be searched by the EVENT ORGANIZER for the presence of illegal or illicit drugs, weapons and/or other prohibited items before or during Your attendance at the Festival or Venue and agree that the discovery of any prohibited item constitutes a violation of the EVENT ORGANIZER’s anti-drug policies and will accordingly give the EVENT ORGANIZER the right to immediately revoke Your License to access the Venue, attend the Festival and to deny You any future admission to the Festival or Venue without any legal or financial liability to You. In exchange for additional consideration, the receipt and sufficiency of which is acknowledged by you and the EVENT ORGANIZER, you accordingly agree to defend, undertake not to sue, indemnify, safeguard and release harmless and forever indemnified for any loss, whether personal injury or property damage, arising out of or relating to your use of illegal drugs, your use of weapons or any other violation of these terms and terms.

PROHIBITED ITEMS AND ACTIVITIES

The following objects and activities are strictly prohibited at the Festival: the use of professional cameras, professional video or audio recording equipment; outside food or drinks; unauthorized sellers or artists; distribute flyers or flyers; pets; oversized bags (authorized bags will be subject to search); skateboards, roller skates, bicycles or the like; wagons; fireworks; radios or other music players; placards or signs; illegal behavior of any kind; conduct that unreasonably interferes with others’ enjoyment of the Festival or poses a threat to public safety, as determined in the sole discretion of the EVENT ORGANIZER. EVENT ORGANIZER reserves the right to terminate your license to use the Site at any time if you engage in prohibited activities.

MISSION

EVENT ORGANIZER shall, at any time, have the right to assign or delegate all or any of its rights, title and interest or duties hereunder without notice or consent to you.

INTEGRATION CLAUSE

You agree that the terms and conditions contained herein, and as amended from time to time by the EVENT ORGANIZER, represent the entire agreement between you and the EVENT ORGANIZER with respect to its subject matter, and supersede all prior agreements, communications, and understandings, written or oral, regarding such subject matter.

ARBITRATION OF DISPUTES

Notwithstanding anything to the contrary contained herein, you agree that any dispute arising out of or relating to your purchase of Tickets hereunder or any related transaction relating to the use of the Site or its Services or any relationship or dispute between you and THE EVENT ORGANIZER or you and any company or person employed by or affiliated with any of the EVENT ORGANIZER, this Agreement and/or any policies or practices of any of the companies or persons mentioned above (a “Dispute”) will only be resolved subject to FINAL AND BINDING ARBITRATION as set forth in this section, and may only be resolved through individual arbitration governed by the Federal Dispute Act. arbitration or by applicable sections of California law to the maximum extent permitted by applicable law. THE PARTIES TO THIS AGREEMENT WAIVE THEIR RESPECTIVE RIGHTS TO GO TO COURT in connection with any Dispute and that such rights will be determined by a NEUTRAL ARBITRATOR, AND NOT BY A JUDGE OR JURY. AUCUNE PARTIE À LAQUELLE LE PRÉSENT ACCORD S’APPLIQUE NE DOIT INTRODUIRE OU PARTICIPER À UN RECOURS COLLECTIF OU AUTRE PROCÉDURE COLLECTIVE EN RELATION AVEC UN LITIGE. The parties must participate in non-binding mediation before commencing any arbitration (or taking any other action). If the parties are unable to resolve a Dispute through informal means, the arbitration of Disputes will be administered by the Quebec Department of Justice in accordance with the Commercial Arbitration Rules, and if the arbitrator deems it appropriate.

REFUND DISPUTES

In light of your agreement to all terms and conditions contained herein, including that “there will be NO refunds or exchanges with respect to ticket purchases” as set forth in the Ticket Policy, you further agree, in accordance thereto, that under no circumstances will you commence a refund dispute with your credit or debit card with respect to tickets or services purchased hereunder or with respect to any amounts lost hereunder or any similar charge reversal . You further agree that EVENT ORGANIZER has no legal obligation to mitigate any of its potential or actual losses incurred hereunder.

REFUNDS IN FOREIGN CURRENCIES

the EVENT ORGANIZER will not be responsible for any exchange losses incurred during the ordering or refund process. EVENT ORGANIZER will not be required to issue refunds to ticket purchasers who have mistakenly purchased tickets in a currency other than the intended currency.

MISCELLANEOUS

By purchasing Ticket(s), You acknowledge and accept that You are at least 18 years old. You cannot share or duplicate tickets. Tickets must not be used for advertising, promotional purposes (including competitions and sweepstakes) or other commercial purposes without the express written consent of the EVENT ORGANIZER.
